The community's reaction to TPCi's lawsuit is overblown and largely unfounded

    Posted: 26 Nov 2019 09:05 AM PST

This is a post adapted from a comment I made in another thread so that it can get greater visibility to try and combat some misconceptions.

I'm not a lawyer and this post is not legal advice. This is general knowledge about contract actions and complaint drafting.

Okay there is a lot of misinformation going around about this issue, and there is a feedback loop where misinformation breeds more misinformation. People looking to be mad about something that simply isn't worth getting mad about.

What this lawsuit is NOT about: Going after random people who uploaded the game, datamined the game, or exposed issues with the game pre-release.

What this lawsuit IS about: Locating contractors who worked on a strategy guide, who signed NDAs, who breached those NDAs, and preventing them from leaking any additional secrets they might have.

(Small edit thanks to helpful comment by /u/newaccountwut below: The defendants are unknown at this time, and the nature of the suit will change when/if they are located. They may not specifically be contractors, although it's reasonable to assume for our purposes that the leaks at issue initiated with people who had access to the guide. The rest of this information about the language of the complaint still applies.)

Basically this is a breach of contract action against contractors who broke NDAs. "Damages" is the term for what you get when someone breaches a contract. There doesn't have to be literal damage, the damage is the breach. The default remedy for damages is money, either the cost of replacing what you lost or the difference between what you got and what you would have had if the contract had been fully performed.

"Irreparable damages" means that money can't repair the breach, either because it's impossible to calculate the loss or because it's not something money can fix. You claim "irreparable damages" when you want an injunction.

An injunction is when the court makes someone do something or prevents them from doing something. If you actually go and read the complaint, you'll see that this is exactly what TPCi wants. They want the court to order the contractors not to give out any other information they might have about TPCi's products.

Why is TPCi doing this? To protect the enforceability and strength of their NDAs going forward. Basically it's a signal to all their other partners not to breach their agreements.

This isn't about heroic leakers exposing the flaws of a game. It doesn't matter whether the game was a best seller or a dud. It's a mundane, totally standard, run of the mill breach of contract action against a handful of specific people who had specific access.

The community needs to stop searching for things to complain about and stirring up controversy about issues that are utterly non-controversial just to feed the disappointment-discussion loop around these games.

If Pokemon is not GameFreaks main priority anymore then they should give another studio a shot at making the next main instalment or even a spin off like Coliseum.

    Posted: 26 Nov 2019 05:50 AM PST

GameFreak said the franchise is not their top priority anymore. (And it showed)

I think Nintendo should give GameFreak a year or two off from making Pokemon games and give it to a well trusted studio that is passionate about the Pokemon franchise and knows the ins and outs of the games.

An example would be when Bethesda gave Obsidian a shot at making a Fallout game (New Vegas) and it's regarded as one of the best of the Fallout Series.

Pokemon Sword and Shield are the lowest-rated all-new Pokemon core RPGs by critics' average, and the third-lowest rated Pokemon core RPGs overall.

    Posted: 26 Nov 2019 04:16 AM PST

After more critics have finally gotten their hands on copies of the new Pokemon games (only 25 review copies were sent out before release), the Metacritic rating is currently sitting at 80 for Pokemon Sword and Shield with 61 reviews:

    https://www.metacritic.com/game/switch/pokemon-shield

These are the lowest-rated Pokemon all-new (new region, generation etc), core RPGs in the series ever.

They are also the third-lowest overall behind enhanced versions Let's Go (78/100) and Emerald (76/100). They are tied with Pokemon Black 2 and White 2, also at 80/100.

"Irreparable injury" to The Pokemon Company

    Posted: 26 Nov 2019 03:22 AM PST

Sword and Shield has encouraged me to approach the game differently and I love that.

    Posted: 26 Nov 2019 06:52 AM PST

Typically I get a team of six rolling and stick with that team for the whole game. I'll swap a few out here and there but usually 5 of the slots are "set" and I bring in a type advantage to each battle.

Now, with access to the Box Link, the wild area and exp share making it less of a grind I find myself playing with all six slots. Carrying around one or two high levels to train up a team specific for each gym.

I've been playing with a larger variety of Pokemon than ever, and it's not too time consuming or grind oriented.

I'm really enjoying playing this game a big differently than I have in the past. I definitely credit the Box Link for a big part of that.

I know a lot of people aren't happy with the game, but I'm having a blast with it.

Edit: Yes, I know that the Box Link isn't new to the franchise.

Ten reasons why dexit is great for the pokemon franchise

    Posted: 26 Nov 2019 07:37 AM PST

Dexit was a controversial move on GameFreak's part but now that we've got to play the new games it appears that dexit is not as bad as it seems. Mr.Ohmori, director of GameFreak announced the national dex won't be returning in the future. For this post GameFreak is "GF" (oh boy I can think of so many similarities between GF and your girlfriend).

So now here are ten reasons how the cut of the pokedex benefits the franchise :

    1. If GameFreak had to include the national dex, they wouldn't have been able to release ShSw on time. It ensures GameFreak produces games with a decent storyline, good quality of graphics and animation, new interesting features, new pokemon. Yes they could've added the nationaldex but at the expense of everything else.
    2. 400 pokemon is more than enough for almost if not everyone. Most people won't use more than 20 pokemon anyway so it seems like a waste of work.
    3. It forces people to use pokemon they didn't before. Yeah try them out you'll be impressed and in the end thankful to let go for once of your Typhlosion, Garchomp, Luxray, Medicham or Mismagius.
    4. New pokedex is easier to complete. Think about it, in the past too few people have been able to complete the national dex. Now it's feasable for more people. More people will be able to enjoy having that sweet certificate and feeling of satisfaction that wasn't achievable in the past.
    5. It sets the boundaries with the pokemon community. It's important for a company to tell its player what is and is not possible. We know that the national dex is not gonna happen for the switch. Just let time pass and sooner or later most people will forget about the national dex. Next summer boycotters too are likely to be in favor of the dexcut.
    6. Online battles balance
    7. People will enjoy the returning pokemon even more. Its like returning to the family after being overseas for six months.
    8. A bigger percentage of pokemon that can be caught in the wild. Instead of wasting time transfering and trading it's better to be able to catch most of the pokedex in the wild.
    9. It's the perfect time to introduce microtransactions and DLCs to the franchise. If fans are so desperate to get the 60% of missing pokemon then this is the solution! It's a win-win situation, GameFreak generate more profit and the fans get what they want.
    10. I dearly hope you are thinking that post is a satire because it IS!

    Peace

Features that should have become series staples, but were dropped for the sake of "making each generation unique"

    Posted: 26 Nov 2019 08:40 AM PST

Title. I've compiled a list of features that should have become series staples after being introduced but somehow were dropped soon after for GF's bullshit reasoning, or are only implemented in some games but not others. These range from things that contribute to world-building, making the in-game world seem more realistic and alive, to features that enhance re-playability and extend the post-game. I also included suggestions for improvements to such features. These will be separated into categories and ranked from most to least important to bring back, in my opinion:

    WORLDBUILDING / IMMERSION:

    • Following Pokémon and Ride Pokémon (with Dexit, there's no reason why every single Pokémon available in a given game that is big enough and the appropriate body type shouldn't be rideable / surfable / flyable with a unique model). Following Pokémon is optional / can be turned off.
    • Seasons (lasting one week instead of one month)
    • Naturally changing weather like rain, harsh sunlight, etc, in routes (should be expanded to apply to the entire overworld, including towns and cities)
    • Time of the day, seasons AND weather affecting what wild Pokémon appear / their rarity.
    • There should still be overworld obstacles that need Pokémon to be removed. The change I suggest is that they should be species specific, not something that needs to waste a move slot (that means every big enough water type can surf, every Pokémon with sharp claws can cut small bushes, every strong physical Pokémon can smash rocks, etc). Implement a "license" or "permit" tied to Gym badges if limiting game progression is a concern.
    • Berry farming and unique tree designs for each Berry type. Having a single kind of "berry tree" that drops mixed berries is ridiculous and immersion breaking. It's also not convenient at all to people who need specific berries. Also, portable Berry planter.
    • Small gender differences for Pokémon (these should probably be a bit more streamlined to reduce bloat and be more on the noticeable side, like the Butterfree stripe or Vileplume dots, and less like the ones that just have barely different sized horns and fangs)
    • Apricorns, Apricorn Trees and Apricorn Balls
    • Weekly and Daily Events like the Bug Catching Contest (could include online compatibility).
    • Hidden Grottoes This is where you should be able to find more powerful than usual Pokémon and / or Pokémon with Hidden Abilities. They should be scattered in the overworld bushes, cave walls, etc and change every day.
    • Swarms / Outbreaks
    • Headbutting trees / slathering honey on trees to encounter wild Pokémon.
    • Horde Encounters / SOS Calls (implement sparingly, specific to some species)

    GAMEPLAY:

    • Challenge Mode, Normal Mode and Beginner Mode.
    • Battle Frontier.
    • Trainer Rematches (Gym Leaders, E4, Champion and select route trainers)
    • In-game special events and locations for mythical / DLC Pokémon instead of them just being handed to you in a Pokémon Center by an NPC.
    • Mega Evolutions (re-balanced) Use Gigantamax designs as Mega Evolutions where possible.
    • Z-Moves (re-balanced, more unique ones)
    • Soaring with any Pokémon that is big enough and can fly. Should be optional, coexisting with traditional flying / fast travel.
    • Pokémon Contests. Should have been fleshed out and expanded, with Contest stats and move effects becoming almost a metagame of its own, preferably making Pokémon that sucked at batting good at contests.
    • Triple Battles, Rotation Battles and Inverse Battles

    CUSTOMIZATION / AESTHETIC TOUCHES:

    • Some sort of Secret Base (like Hoenn / Sinnoh) or a villa / room (like Sinnoh / Johto) that you can decorate with furniture, plushies, etc Should be able to be visited by other players online and locally.
    • Box Wallpapers Could be expanded into actual "areas" that you can organize your Pokémon in based on type and habitat, kinda like Pokémon Ranch or the friend areas from old Mystery Dungeon games, and they walk around in there, play, etc. Obviously it would still include a simpler interface with little sprites to make organization easier.
    • Pokéball Seals / release effect customization
    • Pokéball throwing styles / battle poses
    • Taking photos with your Team / Alola Photo Club

Why doesnt the Pokemon anime do what Yu-Gi-Oh! anime does and have a new protagonist every generation?

    Posted: 26 Nov 2019 06:26 AM PST

Its the one thing I feel Yu-Gi-Oh! has done right in one regard and its given us an interesting new face to look at every new generation of the show. Plus the writers of the show don't have to come up with weird or stupid reasons why a kid from 97/98 is still "10 years old". Especially now that Ash has won a league it would be nice if he took a retirement and allowed a new protagonist to take over.

Maybe I'm in the minority on this opinion, but I would of liked to have seen Gold, Brendan, Lucas, Hilbert, etc be the protagonist during their respective generations.

Blue in Pokemon Masters: "Take the Galar region, for example..."

    Posted: 25 Nov 2019 01:23 PM PST

I think a big leap forward for Pokemon would be if you played an adult trainer.

    Posted: 26 Nov 2019 07:36 AM PST

I know it wouldn't fix gameplay problems those would have to be addressed by GF but i imagine the story would immensely benefit if you could be an adult. They could drop a lot of the childlike themes, develop more gruff looking pokemon, maybe step away from the handholding, and create a story that has a more adult feel to it.

The Battle Tower in this generation is the most disappointing it has ever been.

    Posted: 26 Nov 2019 06:44 AM PST

Spoilers ahead for anyone wanting to find out about the battle tower themselves.

Before I tell you about the battle tower from this gen, let me outline the battle tree from last gen. It had normal singles and doubles matches and then after a set streak, you unlocked super singles and super doubles. The super versions offered more varied and difficult challenges and offered better rewards as you climbed the tiers. For every 10 teams you defeated(up to 50), it would award you more BP than the last tier. If you lost your streak, you had to start over again from the beginning. At the end of a 10 win streak, you would face a "boss" trainer who varied from previous champions, rivals from previous games and elite four from previous games. There were some BS teams, but I liked the challenge that it brought to team building. I played a TON of the battle tree and used all the BP I earned to create new teams with different pokemon.

Now for the battle tower. There are several tiers that you climb up through that give you more and more increasing rewards as you climb. This is pretty cool, however it reaches a maximum after several tiers. After that, you no longer get rewards aside from BP. Now, I don't think this would be a big deal if it actually offered a decent amount of BP. But you get 2 BP no matter how high you go. Aside from this, losing has no impact on your tier or ranking. Losing literally does not matter. But with the new option of having rental teams, it's hard to even do that. I went through the entirety of the doubles tiers with just the rain team and barely ever even lost a pokemon. It's laughably easy, as the only person who actually dynamaxes is Leon, who is also the only boss the battle tower offers.

All in all, it's very disappointing. I know that a lot of people didn't like how previous versions of the battle tower/battle tree/whatever have turned out, but I was happy that they usually at least offered a challenge with scaling rewards. This just sucks and feels bad to play after you get to master rank. I was going to set up a team to use in the battle tower but I've just sort of lost interest after learning how difficult it is to earn BP in it.

    Screw Ballguy

    Posted: 25 Nov 2019 10:28 PM PST

After playing through SwSh, I initially met every encounter with Ballguy with a sense of endearment. After all, it's hard not to love the funny Pokeball man who gives you rare balls for free every time you meet him. But now that I'm in the postgame, I can't look at him the same.

After beating the game I spent countless hours finishing up my dex in order to get the shiny charm. From there I started my quest: to breed a perfect IV shiny Obstagoon. Countless hours of breeding and EV training later, and I have it. Ok, nice, all I need now is a Flame Orb to complete my Guts set. But it's not that simple.

For some god forsaken reason, there's no way to find the Flame and Toxic Orbs in the wild in Sword and Shield, and they can't be purchased for BP or Watts. Instead, it's only known location is as a reward in the Championship Rematch Tournaments, as a random chance of it being granted to you by Ballguy. I've run through the trainers in this "challenge" for hours now, with my level 100 Obstagoon essentially one shotting everything. But still no flame orb.

Each time I grind through the supposed nest trainers, Ballguy greets me. But instead of handing me my desired item, instead he gives me 5 great balls. Or 3 Quick Balls. Or 3 Nuggets. I am essentially the most powerful person in the entire continent, with millions of dollars in my pockets and more pokeballs then mons I will ever need to catch. And yet somehow he thinks he's helping me. He walks out every time, congratulates me, does a little dance, and hands me garbage.

I hate Ballguy. I hate his smile. I hate the nerve of him, using RNG to gate me away from a vital competitive item then taunting me by rubbing his Nuggets in my face. Each time I see his dance I am reminded of the painful grind in this game and I question every decision I've made in my entire life.
